Terms of Service

The service is operated by Dijitalgardrop, Inc. d/b/a Axen AI / Tryaxen AI, a Delaware (USA) corporation, under the trade names "Axen AI" and "Tryaxen AI". Registered address: 1111A South Governors Avenue, #49930, Dover, Delaware 19904, USA. "We/us" means Dijitalgardrop, Inc.; "you" means the natural or legal person accessing the service via tryaxen.ai, app.tryaxen.ai and related pages, panels, APIs and emails.

"Axen Visibility" is our active SaaS product that monitors, classifies and reports how a brand, company, product or domain appears in third-party AI assistants, search systems and data sources.

"Axen Instagram" is our pre-sale product intended to provide content planning, trend research, Reels scripts, campaign and growth workflows for influencers, new brands and active brands.

"User Content" is data you provide: brands, competitors, prompts, texts, images, files, Instagram usernames, links, instructions, campaign details and similar. "AI Output" is any report, score, analysis, recommendation, script, content plan or other output generated by AI systems used by us or third parties. "Plan" is a paid or free service package with specific pricing, quotas and features.

Creating an account, making a payment, placing a pre-order, ticking a consent box or using the service means you accept these Terms, the Privacy Policy and any product-specific policies applying to your order. If you act for a company, you confirm you are authorized to bind it.

Order confirmations, invoices, receipts, product pages and account records form part of the contract. We may lawfully store the time of acceptance, policy version, IP, device, email and checkbox records.

You must be at least 18 and able to enter a binding contract. Persons in sanctioned regions or barred by export-control rules may not use the service.

Axen Visibility may offer features such as brand visibility scanning, source/citation observation, competitor comparison, sentiment classification, technical readiness checks, recommendations and scheduled scans. Supported engines, data sources and scan frequency vary by plan and technical availability.

Axen Instagram may offer modules such as content calendars, trend suggestions, Reels scripts, caption/hook generation, brand tone, campaign plans, profile analysis and chat-based revision. Auto-publishing and social integrations depend on third-party permissions and account type.

Parts of the service may be beta, early-access, experimental, manual or semi-automatic; this may be disclosed on the product page, panel or by email.

We may add, change, limit or remove features for security, legal, third-party API, cost, performance or product reasons. For changes that materially reduce the core value of a paid plan we give reasonable notice; mandatory rights are preserved. Uninterrupted, error-free service in every country is not guaranteed.

Provide accurate, current information and keep it updated. Keeping your password confidential, enabling multi-factor authentication and reporting unauthorized use immediately are your responsibility. We may temporarily lock accounts on suspicious logins, abuse or payment fraud and request verification.

Each Plan may differ in scan counts, brand/competitor counts, seats, retention, AI generation rights, integrations and support level; current limits are shown at purchase. Usage is metered by system records. Exceeding quotas may pause the service or require an upgrade. Circumventing usage limits by technical means is prohibited.

Axen Visibility subscription fees are charged in advance for the monthly or yearly period shown at purchase and renew automatically until cancelled; auto-renewal is disclosed before payment. Prices may exclude applicable taxes. Price changes are notified with reasonable notice before taking effect and you may cancel before the new price applies.

Card details are processed by payment providers such as Stripe; we never store full card numbers on our servers.

Axen Instagram pre-orders are additionally governed by the separate "Axen Instagram Pre-Order & Founding Access Terms". No panel or product access is provided during the pre-sale; the payment is taken as a reservation. In case of a pre-order-specific conflict, the Pre-Order Terms prevail.

You retain ownership of your User Content and grant us a worldwide, limited, non-transferable licence (extendable to sub-processors) to the extent needed to provide, secure and support the service and generate outputs. You confirm you hold the necessary rights to what you submit and that it violates no privacy, IP, advertising or personality rights. Do not upload special-category personal data, health data, children's data, payment cards, government IDs, passwords or secrets unless strictly necessary.

If you connect Instagram/Meta or another platform, only the permissions you approved are used; some features depend on the platform's API, review, quota or account-type rules. Access tokens are stored securely; removing the connection stops future access. Tryaxen is not affiliated with, or an official representative of, Instagram, Meta, OpenAI, Google, Anthropic, Perplexity AI, xAI, DeepSeek or other third parties; their names are their owners' trademarks.

AI systems are probabilistic: outputs can be wrong, incomplete, outdated, biased or similar to third-party content, and the same question can produce different answers at different times, models or locations. Review outputs before publishing or relying on them for business decisions.

We do not guarantee followers, views, engagement, sales, revenue, rankings, citations, visibility scores, brand perception or viral results. Visibility scans are limited by prompts, providers, timing, model versions, web access and region — a report is not an exhaustive representation of all AI answers or user experiences. The service is not legal, financial, investment, tax or medical advice.

The following are prohibited (non-exhaustive): illegal use or fraud; infringing others' copyright, trademark, privacy or contractual rights; abuse, harassment, doxxing; spam, fake followers/engagement or manipulating platform algorithms; impersonation and presenting AI content misleadingly as human-verified fact; malware, phishing, credential stuffing or unauthorized security testing; scraping, bots, multi-accounting or bypassing technical limits; uploading sensitive data without a lawful basis; fully automated high-risk decisions with significant effects on employment, credit, insurance, health or legal rights; and using brand monitoring to harass, blackmail or covertly profile individuals.

On suspected violation we may remove content, restrict features or suspend the account, and cooperate with authorities where legally required; where possible you are given a chance to object.

The service, software, interface, design, data models, report templates, brand, logo and documentation belong to Tryaxen or its licensors; you receive only a limited, non-transferable right for the duration of your plan. Copying, reverse engineering, resale, white-labelling or systematic use to build a competing product is prohibited unless your plan explicitly allows it. Rights in AI outputs may vary by country; we do not guarantee an output is copyright-eligible or entirely free of third-party rights.

If you provide suggestions or feedback, you allow us to use them to improve the service without fee or restriction. This never authorizes us to sell your personal data or disclose your confidential information.

Personal data processing is governed by the Privacy Policy, the KVKK notice and applicable data protection law. Where we act as a processor for a business customer's end-user data, a Data Processing Addendum applies.

We may suspend accounts for failed payment, security risk, legal violation, abuse or harm to the platform, giving notice and an opportunity to cure where possible. You may cancel your account and subscription via the panel or support; termination does not erase accrued payment obligations. After termination, User Content is deleted, anonymized or retained per the Privacy Policy and legal retention periods.

To the maximum extent permitted by mandatory law, the service is provided "as is" and "as available"; warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation and results are expressly disclaimed. This does not remove consumers' non-waivable statutory warranty rights.

To the maximum extent permitted by law, Tryaxen is not liable for indirect, incidental, special, punitive or consequential damages, or loss of profit, revenue, data, reputation, opportunity or business. Our total liability shall not exceed the amounts you paid for the relevant service in the 12 months before the event giving rise to liability; for free use, liability is limited to $100 where the law allows. Gross negligence, intent, death/bodily injury, consumer rights and liabilities that cannot be limited by law are outside this cap.

As a business or professional user you agree to defend and indemnify Tryaxen for reasonable third-party claims and costs arising from your User Content, unlawful use, third-party rights violations or breach of these Terms. For consumers this clause applies only to the extent permitted by applicable law.

We are not responsible for delay or failure caused by events beyond reasonable control: natural disaster, war, terrorism, epidemic, labor dispute, power/internet outage, cyberattack, government action, API or cloud provider outage.

These Terms do not limit non-waivable consumer protection rights in your country of residence. Withdrawal, conformity, defect, auto-renewal and disclosure rights for online digital services vary by country. Where required, separate express consent is taken from consumers who request the service to start before the withdrawal period ends, including acknowledgment of its effect on the withdrawal right.

Subject to mandatory consumer provisions, these Terms are governed by the laws of the State of Delaware, USA. The parties first pursue a good-faith resolution via legal@tryaxen.ai for at least 30 days. If unresolved and local consumer law does not designate another forum, the competent state or federal courts in Delaware have jurisdiction; small-claims and mandatory administrative remedies remain available.

You may not assign this contract without our written consent; we may assign it in a merger, restructuring, asset sale or to an affiliate — your data rights remain protected. We announce material changes by email, panel or website; changes take effect on the stated date and continued use may constitute acceptance, with separate consent taken where legally required. Invalidity of one clause does not affect the rest; non-enforcement is not waiver.
